This is the way I see it will eventually roll at the Supreme Court: no military troops for domestic unless a governor cries help; but given the BAD procedural changes to Posse Comitatus made during the Obama tenure,
they will saction unilateral deplloyments of the Guards. As they often do, the Court will go: “Hey, you don’t like it? Undo the rule change from the Obama years.”
Another way I think Cohen and Kirschner are looking at this through rose colored glasses is that there is no “rebellion”. The No Kings protests, considering the large numbers, were impressively non-violent; but we are continuing to see roudy anarchist behavior in LA. Those anarchos are a bunch of cretins who, in their logic, WANT a military junta -“..it’s the penultimate step to its inevitable overthrow and the ushering in of our anarcho utopia, mannn…”

The Feds were throwing flash bangs from unmarked cars to mislead people that it was protesters using fireworks.
I have no delusions; anarchos were also on occasion hurling cinder block. But the use of flash bangs thrown from unmarked cars by Feds/ICE was a tactic to make a later self-fulfilling case in court that things were out of control. But the Feds had a big hand in making things out of control. I hope lawyers make sure to get on record that such actions were taken to later mislead both the public and the courts…
